It's time to talk about technology again

Legal Ethics & Legal Technology      To everything there is a season, and this is the season when my thoughts always turn to ... no, not love, but legal technology.

The reason, of course, is that ABA TechShow is just around the corner. TechShow 2006 will boot up in Chicago on April 20, and the agenda indicates that it will be another great conference on legal technology.  If you are planning to attend, you should register before March 10 in order to get the "early bird" discount.

Once again, I have decided to focus this weblog on the intersection between legal ethics and legal technology in conjunction with TechShow.  I will continue to post about other aspects of legal ethics as items of interest come to my attention.  However, I intend to concentrate on the ethical dimension of legal technology from now until the end of TechShow in late April.  Those posts will be flagged by the same logo that appears at the top of this post.

There's plenty to talk about; in fact, it would be fair to say that the field of legal ethics is increasingly concerned with issues raised by new kinds of information and communication technology.  Conversely, it would be fair to say that practicing lawyers need to be concerned about the ethical issues involved in their choices about law office technology.

The problem is not that there has been any significant change in a lawyer's essential ethical duties. Rather, the problem is that technology has proven to be a double-edged sword -- a tool and a source of risk -- in the fulfillment of those ethical duties. Recent examples abound.  They include Google Desktop, metadata and inadvertent transmissions of confidential information.

I hope to create a small library of useful information and links about such matters over the next seven weeks, prior to TechShow.  If that sounds interesting, stay tuned!
